Terms & Conditions of KaiZen

by KAIZEN TECHNOLOGIES S.R.L. (“Kaizen”, “we”, “our”),
a company registered in Romania, with its registered
office at Str. Fagului 20A, Afumati, Ilfov County, and
fiscal identification number 52241443.
1. Introduction
Welcome to kaiZen. These Terms & Conditions govern the purchase, use, and management of our Android App, a custom Device Policy Controller (DPC), its adjacent apps (kaiZen Icons, kaiZen Launcher, Zen Garden) and its associated enrollment tokens (or license codes). By purchasing an enrollment token and/or installing the DPC on your device, you agree to these terms. Our DPC is designed to enforce device management by restricting app installation to a remotely updated whitelist and by limiting its own removal, based on your selected configuration at purchase.
2. Usage, Purchase & Licensing
2.1. Usage of the Device Policy Controller (DPC)
The DPC enforces the rules listed below. To do so, it requires Device Owner privileges, which are granted by the user after the installation process.
- Only allows installation of apps included in a whitelist, which is updated remotely at most once every 72 hours.
- If selected at purchase, enables the temporary removal of restrictions by enabling Emergency Mode, for up to 2 hours per week. It is enabled by default for the trial version.
- Removal of the DPC or its restrictions is possible after a mandatory wait period, selectable at purchase: 3, 7, 14, or 30 days. For the trial version, this wait period is fixed at 1 hour.
- Removal may require consent from up to 3 designated accountability partners, if this option was selected at purchase.
- After the delay period, the DPC gives up the Device Owner privileges, which lifts all restrictions. The DPC can then either be uninstalled normally, or can be reactivated with a new enrollment token.
2.2. Setup and Installation
The DPC can be installed through one of the following setup flows:
A. New Device Setup
- For new or factory-reset devices, the DPC can be set as Device Owner during the Android setup wizard, by scanning the QR code of the enrollment token.
- The DPC can either be activated with a free trial enrollment token, or with a purchased enrollment token.
B. Existing Device Setup
- The DPC may be installed as a standard Android application.
- To enable Device Owner privileges, the DPC guides the user through a setup process involving:
a. Establishing a local ADB server and connecting via wireless debugging.
b. Temporarily disabling user applications with accounts using ADB.
c. Prompting the user to log out from system applications with accounts.
d. Configuring Device Owner privileges via ADB commands.
2.3. Free trial
- Free trials are limited to one activation per device and may last no longer than seven (7) days.
- Trial usage is tracked via the device serial number hash to prevent multiple activations.
- After the trial period, continued use requires a valid enrollment token.
2.4. Enrollment Token Purchase
- Enrollment tokens (license codes) may be purchased via our website through DodoPayments, our Merchant of Record.
- Tokens are delivered as alphanumeric codes or QR codes and are required to activate a lifetime premium license for the DPC.
2.5. Usage Restrictions
Users must not attempt to circumvent, disable, or hack the DPC restrictions or its update mechanism with negative intent (i.e. exposing a way to bypass restrictions to the other users).
3. User Responsibilities
- Users are expected to report any software malfunctions or security vulnerabilities they may discover, so we can promptly fix them.
- Users must ensure that enrollment tokens are kept secure and only used as intended.
- Users must respect the accountability partner consent process if enabled.
- Violation of these terms may result in permanent lockout or other enforcement actions.
4. Refunds & Cancellations
- Enrollment tokens can be refunded after at most 3 days for activated licenses, or 14 days for licenses yet to be activated.
- In the case of a refund for an activated license, the Device Owner privileges will be automatically lifted, together with the restrictions, and the license will be terminated.
5. Warranty & Support
- We provide support for software issues related to the DPC.
- We are not responsible for hardware issues or software outside the scope of the DPC.
6. Liability & Disclaimers
- We are not liable for any data loss, device malfunction, or third-party software compatibility issues caused by the DPC.
- Users assume all risks related to device management restrictions enforced by the DPC.
- To the extent permitted by law, for any claim not already excluded above, our total liability for the damages generated by a license is limited to the price paid for that license.
7. Updates & Changes
- We reserve the right to update the DPC software and whitelist remotely.
- These Terms & Conditions may be updated at any time. Users will be notified of significant changes by email or via our website.
- Continued use of the DPC or enrollment tokens after changes constitute acceptance of the updated terms.
